CDM Regulations 2015

As of 6th April 2015 there have been changes to the CDM (Construction Design and Management) Regulations. With these regulations come responsibilities for ALL parties involved with construction projects including (but not exclusively) Clients, Designer and Contractors.

Details of specific responsibilities can be found at www.hse.gov.uk . PART 2 outlines CLIENT’S responsibilities.

Each project will have difference responsibilities depending on the complexity of the individual project.

  1. Construction work where only 1 contractor (or sub-contractor) is employed on site.

    The Client must appoint, in writing, an individual Contractor to carry out the construction work. The Contractor will supply a risk assessment and method statemen (RAMS) for the work involved and also produce a basic construction phase plan for the works. Site control/access/security along with welfare provision and site inductions to be the responsibility of the Client unless the site has no available welfare facilities in which case these will need to be provided by the Client/Principal Contractor.

  2. Construction work where more than 1 contractor (or sub-contractor) is employed on site.

    1. Client must appoint, in writing (as early as possible in the design process), a Principal Designer to help the Client collate pre-construction information and co-ordinate matters relating to health & safety during the pre-construction phase to ensure that, as far as is reasonably practicable, the project is carried out without risks to health and safety. Information collected will form part of the Health & Safety file.

    2. Client must appoint, in writing (as early as possible in the pre-construction phase) a Principal Contractor to help the Client meet their duty to ensure a Construction Phase Plan is drawn up before the construction phase starts. An early appointment also give the Principal Contractor time to carry out their duties e.g. preparing the Construction Phase Plan, and to liaise with the Principal Designer to share any information that may be relevant for Health & Safety (Health & Safety file). Site control/access/security along with welfare provision and site inductions to be the responsibility of the Principal Contractor, unless on an existing Client site where these responsibilities may be shared – this element to be discussed and agreed during the pre-construction phase.

    3. Contractors on site (either appointed by the Client or Principal Contractor) will supply RAMS for the work involved and fall under the supervision (for Health & Safety) of the Principal Contractor and/or Client depending on the site setup.

If the Client does not appoint a Principal Designer or Principal Contractor then the Client must carry out their duties.

Upon placing an order, Re-Space Ltd must be given copies of any F10 certificates (if applicable) and Project Directory containing all site management contact details/appointments.

Unless otherwise stated we have assumed that you are aware of the duties under the CDM 2015 Regulations and acknowledge the acceptance of these duties in accordance with the regulations:

  • An induction is required under CDM2015 – the induction will include any site specific rules, locations of First Aid, welfare and emergency procedure must points and any other relevant information. This induction must be given to ReSpace Ltd’s site operatives/installers by yourselves.
  • ReSpace Ltd hereby declares its role as Contractor under CDM 2015 Regulations for this contract and this role is accepted. We are not the Principal Contractor or Principal Designer.
